Frozen Foreclosures Burn Buyers | Chappaqua NY Real Estate ...

Six months after the historic agreement between 49 attorneys general and leading lenders, foreclosure and pre-foreclosure inventories are as high as they were in January, even as investors and first-time buyers fight over scarce discounted properties in the marketplace.

More than three and a half million homes are either 90 days delinquent on their mortgages or in the June foreclosure inventory, but not yet on the market to be sold.? That?s a five percent decline since January, according to the latest data from Lender Processing Services, but still the equivalent of nearly four years? worth of national foreclosure sales.

One reason for the stubbornly high backlog is increased foreclosure starts. Foreclosure starts ? notices of default or scheduled auctions ? increased in 31 states in the second quarter in June from a year earlier, according to RealtyTrac., California had an 18 percent increase in starts, which helped boost the state?s foreclosure rate for the month to the highest in the nation for the first time since RealtyTrac began issuing its report in January 2005. ?At the same time, foreclosures sales are down in Western states, especially California, where June foreclosure sales were down 13.4 percent over last month, and down 48.8 percent vs. June 2011, according to ForeclosureRadar.

Foreclosure processing continues to be slow.? The foreclosure process increased to an average of 378 days in the second quarter, the highest in records dating back to 2007, according to RealtyTrac.? In the first and second quarter of 2012, properties averaged 16 months of delinquency before getting foreclosed on, according to a survey of delinquent owners by the YouWalkAway.com web site. This reflects an increase in the number of months a borrower is delinquent before foreclosure starts are filed and foreclosures are completed and implies lenders and servicers are processing older foreclosures and homes that have been in default for over a year. Underwater homeowners in the survey who received a foreclosure start notice were 11 months behind on their payment. Last year, it took an average of 9 months of nonpayment before the foreclosure process started.

As a result slow processing and increased demand, REO inventories are so tight that bidding wars are breaking out and not even an upsurge in short sales-caused in part by lenders and owners frustrated by dealing with the stymied foreclosure process-can satisfy the demand.? Once a rarity, pre-foreclosure sales, almost all of which are short sales are expected to as many as 400,000 by the end of 2012, about the same level as foreclosure sales, according to RealtyTrac.

The signing of the landmark Attorneys General agreement last March was supposed to relieve the backlog and speed the processing of foreclosures, yet to date it has failed to halt the confusion, delays, and legal and regulatory roadblocks that are keeping foreclosures bottled up.

The standards for foreclosure processing mandated by the agreement are still a work in progress.? In April, Joseph Smith, appointed by the US District Court to monitor the agreement, announced it will take at least six months for his office to have in place a process to oversee compliance to the new standards.? These are critical for lenders, because they will provide a degree of legal protection against lawsuits challenging their processing of foreclosures.? Those lenders who have proceeded to process and sell foreclosures from their inventories before standards are in place are taking a risk.

While government agencies work on ?global? standards, several federal agencies that regulate lenders have proceeded with their own regulations governing lenders.? The Office of the Comptroller of the Currency issued standards last month for the depository institutions it regulates.? The Consumer Finance Protection Board is working on mortgage service standards and other agencies may do the same.

At the state level, legislation and litigation are changing the playing field for lenders, causing delays in foreclosure processing.? In Florida, 340,000 foreclosures are in limbo pending a ruling from the state supreme court due early next year.? The Oregon Supreme Court announced recently it will rule on the mortgage industry?s controversial loan tracking system and its role in foreclosures.? In Nevada, a new state law took effect last October 1 that, among other things, makes it a felony and threatens to hold individuals criminally liable for making false representations concerning real estate title. Individuals are also subject to civil penalties of $5,000 for each violation.? Nevada foreclosure filings have plunged as a result. Last week California passed legislation to go into effect January 1 that restricts dual-track foreclosures, where a lender forecloses on a borrower despite being in discussions over a loan modification to save the home. It also guarantees homeowners a single point of contact at their lender with knowledge of their loan and direct access to decision makers, and imposes civil penalties on fraudulently signed mortgage documents. In addition, homeowners may require loan servicers to document their right to foreclose.

The drought of lower-priced homes, especially foreclosures, is radically changing markets like Phoenix, once the hottest of all investor markets.? ?Investors are being priced out of the market,? Chris Broglia of Gilbert-based Solutions Real Estate told the Arizona Republic last week. ?Buyers are being enticed by lower interest rates, and more regular homeowners see they can finally sell again.?

?The distressed market is drying up; normal sales are on the rise ? both great signs for the Phoenix-area market,? said Matt Widdows, founder and chairman of Phoenix-based HomeSmart.

But not everyone is encouraged. ?Once this shadow inventory hits the market, housing prices may lower and create a new wave of strategic defaults and foreclosures,? Jon Maddux, CEO of YouWalkAway.com, told Bloomberg.

BP hit with $3.1 bn Russian court bill

A Siberian court on Friday piled more legal pressure on BP by ordering the British group to pay $3.1 billion in damages for its attempted Arctic oil exploration tie-up with the state giant Rosneft.

A BP attorney immediately denounced the decision as a "corporate attack" that demonstrated the court's subservience to the Russian government's wishes.

The ruling came just days after BP entered direct talks with Rosneft over a buy-out by Russia's largest oil company of the British firm's stake in the troubled TNK-BP joint venture it co-owns with four local tycoons.

A lawyer for minority TNK-BP shareholder Andrei Prokhorov -- the unheralded plaintiff at the heart of Russia's biggest business court case -- said the 100-billion-ruble ruling was issued against London-based BP plc and its BP Russia Investment Limited venture.

"We are fully satisfied," attorney Dmitry Chepurenko said by telephone from the oil-producing region of Tyumen.

Prokhorov -- owner of just 0.0000106 percent of a venture responsible for nearly a third of BP's oil -- denies acting on behalf of the powerful oligarchs who operate their half through the Alfa Access Renova (AAR) consortium.

AAR successfully blocked the Arctic deal in a European court of arbitration by arguing that BP had an obligation to offer TNK-BP priority rights to any operations it would like to conduct across the country and Ukraine.

Prokhorov said TNK-BP Holding suffered from unrealised gains by being shut out of the $16 billion share-swap and joint exploration venture.

The Arctic venture eventually went to the US super-major ExxonMobil. TNK-BP for its part reported a slump in second quarter profits Friday to $808 million from $2.2 billion last year due to lower prices and higher export taxes on old fields.

The Siberian ruling will make no immediate financial impact on BP because it can still fight it in higher courts -- a process that Prokhorov's attorney said could take "at least" six months.

But it will also remind BP of the other court battles it has waged -- and often lost -- in Russia when facing complications with either its tycoon partners or the state.

"This court ruling seriously damages the Russian court system's reputation and proves its inability to defend honest investors against illegal corporate attacks," BP lawyer Konstantin Lukoyanov told RIA Novosti.

"All of the plaintiff's claim are based on absurd assumptions that have nothing in common with the interests of TNK-BP or its shareholders," the BP lawyer said.

Most economists agree that Prokhorov's case would have never survived either the European or US court systems.

The controversial claim had already been rejected once in November -- a move that came just two months after British Prime Minister David Cameron addressed the issue with Russia's ruling tandem of Vladimir Putin and Dmitry Medvedev.

But it was picked up again this year just as BP was entering another war of words with the AAR billionaires over future TNK-BP strategy and dividend payments.

BP eventually put up its half of Russia's third-largest oil company for sale in July 1 and received a quick bid from the tycoon's themselves.

Rosneft entered the fray as expected this week and has three months to negotiate an agreement that could see BP lose an instant cash source that has provided $19 billion in dividend payment's since TNK-BP's creation in 2003.

Analysts believe BP views a deal with Rosneft as a way of improving its relations with the Russian state and potentially regaining access to lucrative unexplored reserves.

Harman Kardon CL


Harman Kardon is a fixture in the audio world, blending unique visual design and high- quality performance to make stand-out products like the SoundSticks III PC speakers ($169.95, 4.5 stars). Aside from a couple of in-ear models several years ago, headphones have not been part of the speaker manufacturer's lineup, so the Harman Kardon CL ($199.95 direct), is something of a debut for the established speaker company. This well-designed pair of headphones offer solid audio performance and, like most Harman Kardon products, looks good doing it. The headphones are reminiscent of the lineup from Bowers & Wilkins, another speaker icon that has recently tried its hand at consumer-level headphones. The CL is a strong first attempt, but it has some fierce competition in the $200 price range.

Design
As mentioned, a quick look at the CL, and one headphone pair immediately comes to mind: The Bowers & Wilkins P5 Mobile Hi-Fi Headphones ??(4.5 stars). Both pairs are on-ear (supra-aural) headphones with rectangular earpads and a design that feels simultaneously retro?in the space age sense?and modern, thanks to the use of black leather and metallic accents. However, it's the Bowers & Wilkins P3 ($199.99, 4 stars) that the Harman Kardon CL ?matches up with in terms of price. And for this price, you get a few more extras than you do from B&W.

The CL, which folds down flat like many modern headphones, features a removable cable?which helps increase the value of the pair, as you can replace the cable without having to replace the headphones if it's the only thing that is damaged?as well as a removable headband. The metallic headband acts as a sort of shock mount for the secondary padded leather headband that sits underneath it, which is the part that actually touches your head.

Unlike most headbands, the CL's metallic and leather combo more or less adjusts itself to your head; you needn't fiddle with it to get the right fit. The size of the metallic band makes all the difference in the world here?a small and large band are included?so if they are uncomfortable at first, try switching out the bands. Generally speaking, the fit is very secure and comfortable. But over longer listening periods, the earcups can feel as if they're pressing too firmly against your ears. If you wear glasses, this can be a bit uncomfortable, but not so much that it's a deal-breaker.

The CL ships with a far nicer case than the equally-priced P3 . The P3's is sturdy and small, but it's sometimes a struggle to fit the headphones completely into its tight confines, whereas the CL's case is less deep, but larger. It looks like a black leather daily planner from some angles. This is possible because, when the CL's earcups fold down flat, the headphones become quite narrow, and there's no need for a deep case. The P3's case probably protects the headphones better, if you manage to stuff them entirely in there, but the CL's carrying pouch is one of the classiest accessories we've seen accompany headphones, so that's got to count for something.

The iOS controls and microphone built into the cable, along the left ear, allow for answering and ending calls, as well as adjusting the volume and navigating tracks. Call clarity is fine.

In an era dominated by in-canal earphones and bulkier over-the-ear (circumaural) headphones, like the Beats by Dr. Dre ?(4 stars), Harman Kardon and B&W seem to be dialing back the bulk and focusing primarily on simplicity and style. Thankfully, both manufacturers are also both quite focused on audio performance.

Performance
The Harman Kardon CL packs a nice punch?rich, deep bass without going overboard, combined with crisp highs and plenty of definition in the mids. Unsurprisingly, the same can be said about Harman Kardon's excellent Soundsticks III , a PCMag favorite?though those are computer speakers. The CL does produce the slightest hint of distortion at absolute maximum volume on some tracks with seriously deep bass, but the distortion is so negligible and barely noticeable?and that listening level is so unsafe for human ears?we're not going to dwell on this other than to briefly mention it. Basically the CL offers powerful, clean playback for 95 percent of the music out there at absolute maximum volume, and all music at just one volume notch below, which is still a higher volume level than you should be listening at.

The Knife's "Silent Shout" is the minor distortion culprit, but again, the distortion is so minor, it's nearly undetectable. At a hair below maximum volume, it disappears completely, and the bass response is quite deep, resonant, and intense. This song's powerful electronic kick drum beat is aided by the clarity and crispness of the high-mids and highs the headphones produce.

The CL really shines on classical music, like John Adams' piece, "The Chairman Dances." The pulsating brass lines are punchy, while the corresponding parts for the lower-register strings are delivered with an appropriate amount of resonance?nothing booming, but nothing too thin, either.

Pop, rock, and hip hop all sound fantastic on the CL?David Bowie's "Golden Years" lets the excellent, hard-panned guitar work shine while the headphones still provide plenty of clarity for his excellent vocals, and just the right amount of thump and low-end from the rhythm section. Jay-Z and Kanye West's "No Church in the Wild" has a beat that the CL delivers with an intensity that at times feels like it could match a massive club PA system, but clarity always seems to be the priority, so with all of these genres, things are never muddy.

This brings us to the primary difference between the B&W P3 and the Harman Kardon CL. The CL's clarity comes from its crisp highs and well-defined mids. There's some exaggeration there, for sure, but it's not over-the-top and it never sounds harsh. The P3 never sounds bad, either, but it delivers a much different sound signature. Both pairs have substantial bass response, but the P3 couples its low-end with far less sculpting in the high frequencies. Side by side on the same tracks, you might think the P3 even sounds a bit muffled, but on its own, it sounds fantastic, as well?it simply doesn't boost the highs and mids with the same intensity as the CL. If you've whittled your shopping down to these two pairs, that is the primary difference between their sonic performance.

Perhaps $200 is not within your budget, but you'd still like a pair of on-ear headphones with iPhone controls. Luckily, there are plenty of choices, though you will have to take a step down a bit in terms of audio performance. The Senta-40 Wood headphones by C. Crane ?(3.5 stars)? and SOL Republic Tracks ?(4 stars) are both solid, less- expensive options. If you're looking for an in-ear pair that delivers similar performance to the CL and P3?we've yet to test Harman Kardon's new earphone pair, but the Bowers & Wilkins C5 In-Ear Headphones ?(4.5 stars) are, unsurprisingly, similar in sound signature to the CL and P3.

If I personally had to choose between the P3 and the CL, however, it would be tough. I do prefer the added bit of crisp edge the CL packs in the highs, but it is noticeably less comfortable over long-term listening sessions than the P3?especially if you wear glasses like I do. Both pairs, however, are worth your serious attention if you're looking in the $200 range.

(AP) ? AIDS is graying. By the end of the decade, the government estimates, more than half of Americans living with HIV will be over 50. Even in developing countries, more people with the AIDS virus are surviving to middle age and beyond.

That's good news ? but it's also a challenge. There's growing evidence that people who have spent decades battling the virus may be aging prematurely. At the International AIDS Conference this week, numerous studies are examining how heart disease, thinning bones and a list of other health problems typically seen in the senior years seem to hit many people with HIV when they're only in their 50s.

"I'm 54, but I feel older," said Carolyn Massey of Laurel, Md., who has lived with HIV for nearly 20 years.

"When I hear young people talk about, 'Well you get HIV and you take your drugs and you'll be all right' ? that's just not the truth," she said. "This is a lifelong thing we're talking about, and it unfolds every day on you."

The graying isn't just because people like Massey are surviving longer. Some of it comes from older adults being newly diagnosed, a trend U.S. health officials say is small but slowly growing. Yes, grandparents still have sex ? and that's an age group missed by all those hip safe-sex messages aimed at teens and 20-somethings.

"They let down their guard," is how Dr. Kevin Fenton of the Centers for Disease Control and Prevention puts it.

Already, a third of the nearly 1.2 million people living with HIV in the U.S. are over 50, and by 2020 half will be, Fenton said at one of numerous sessions on aging at the world's largest AIDS meeting.

People 50 or older accounted for 17 percent of new HIV diagnoses in 2009, according to the CDC's latest data. That's up from 13 percent in 2001.

There aren't as good counts in poor regions of the world, where access to life-saving medications came years later than in developed countries.

But even in hard-hit sub-Saharan Africa, home to most of world's HIV-infected population, studies suggest 3 million people living with HIV are 50-plus, said Dr. Joel Negin of the University of Sydney in Australia. By 2040, he said, that could reach 9 million.

There, challenges are different. Ruth Waryaro of Kenya, addressing the conference on her 65th birthday, said clinic workers hassle her when she goes to pick up her monthly supply of medication ? not believing a grandmother really needs it.

"If you're not strong enough, you just leave the medication and go home," said Waryaro, who raised four children of her own and now is raising four AIDS orphans. She also has diabetes and high blood pressure.

As Negin pointedly told the conference, "50 is not old." But for years, world health authorities didn't even measure HIV in people beyond age 49.

Today, people who are diagnosed and treated early can expect a near-normal life-span, Dr. Anthony Fauci, infectious disease chief at the National Institutes of Health, told The Associated Press.

The new focus is on what these pioneering survivors can expect as they reach their 50s, 60s and beyond. They're now getting chronic illnesses such as heart disease, diabetes, kidney disease and osteoporosis ? some of the common ailments when anyone gets old. But studies suggest people with HIV may be at higher risk for some of those illnesses, or get them earlier than usual.

"It's almost created a new subspecialty of medicine," Fauci said.

Perhaps the strongest evidence links HIV and an increased risk of heart disease. Some AIDS medications raise that risk. But in research published for the AIDS meeting, scientists at Massachusetts General Hospital uncovered another reason.

They scanned the arteries of people with and without HIV, and found the HIV patients had more inflammation inside their arteries, putting them at risk for the kind of clots that trigger heart attacks. That's even though the HIV patients had their virus well-controlled and weren't that old ? their average age was 52, the researchers reported in the Journal of the American Medical Association.

HIV triggers body-wide inflammation as a person's immune system tries to fight the virus, a process that persists and can quietly damage organs even with good medications, CDC's Fenton said.

HIV is not acting in a vacuum, said Dr. Amy Justice of Yale University, noting that people's histories of smoking, for example, also contribute to inflammation.

But she pointed to data from a Veterans Affairs study that said older people with HIV use more medications for other diseases than HIV-free patients the same age.

At the conference, some older people with HIV lined up to have their photographs made and their personal histories recorded, part of a Web project called "The Graying of AIDS."

It's a chance to be counted, and share knowledge.

"We're so concerned about the youth factor, we forget about the people who've brought us thus far," said Massey, the Maryland woman, who leads an HIV group called Older Women Embracing Life and works with churches to raise HIV awareness.

CDC's Fenton noted that those voices can help other older adults realize they're at risk, when they're getting back onto the dating scene after years of monogamous relationships. Older people don't use condoms as much as younger people.

"We still have this huge issue with stigma so thick you can cut it with a knife," says Massey, who also wants HIV testing to become a routine part of health check-ups. "We have to normalize the conversation."

(AP) ? Some of the victims fighting for their lives after being wounded in the movie-theater shooting rampage may face another challenge when they get out of the hospital: enormous medical bills without the benefit of health insurance.

Members of the public, along with Warner Bros., the studio that released the Batman movie "The Dark Knight Rises," have contributed nearly $2 million to help victims, though it's not clear how much of that will cover medical expenses. One family is raising money on its own online.

And three of the five hospitals that treated victims said Wednesday they will limit or completely wipe out medical bills.

Some of the victims, however, still face a long recovery ahead and the associated medical costs ? without health insurance. There's no exact count of how many of them don't have insurance but statistics suggest many of them might not be covered.

Nearly one in three Coloradans, or about 1.5 million, either have no health insurance or have coverage that is inadequate, according to a 2011 report by The Colorado Trust, a health care advocacy group.

The highest uninsured rate was among adults between 18 and 34 and many of those injured in the shootings are in that age group.

State officials said they are not sure whether any of the victims qualify for emergency Medicaid assistance available to needy patients. Victims could also get financial assistance from a state program that helps people hurt during crimes, including lost wages and counseling.

Among the uninsured victims of the movie-theater attack is a 23-year-old aspiring comic, Caleb Medley, who is in critical condition with a head wound and whose wife, Katie, gave birth to their first child, Hugo, on Tuesday.

His family and friends said they have set a goal of raising $500,000 to cover his hospital bills and other expenses and were over halfway there on Wednesday.

"All the money that is donated is going straight to Caleb, Katie and Hugo to help them with medical bills, getting back on their feet, help with the baby items," friend Michael West said. "Anything and everything that they need."

Children's Hospital Colorado announced it would use donations and its charity care fund to cover the medical expenses of the uninsured. For those who do have insurance, the hospital says it will waive all co-pays.

"We are committed to supporting these families as they heal," according to a statement from the hospital, which treated six shooting victims.

HealthOne, which owns the Medical Center of Aurora and Swedish Medical Center, also says it will limit or eliminate charges based on the individual circumstances of the patients. Those hospitals have treated 22 shooting victims. However, the company cautioned its policy may not apply to all doctors working in its hospitals.

The other two hospitals, Denver Health Medical Center and University of Colorado Hospital, where Medley is, wouldn't directly say whether they would assist shooting victims. However, they are the state's top two safety net hospitals and provided combined $750 million in free care in 2011.

Hospitals are required by federal law to stabilize patients during emergencies without regard to their ability to pay.

"The issue most probably facing the hospitals and patients in a situation like Aurora is what comes after 'stabilization,'" said Dr. Howard Brody, director of the Institute for the Medical Humanities at the University of Texas Medical Branch in Galveston and a frequent critic of excessive medical costs.

"Many of these people I assume will need prolonged and expensive rehabilitation after their immediate injuries are dealt with, and that seems precisely what hospitals today are less and less willing to cover out of their own funds, and no law requires that they do so, as far as I am aware," he said.

Medley is in a medically induced coma, but West said he has been showing signs of improvement, relying less on a ventilator to breathe. Medley's wife, 21-year-old Katie Medley, gave birth on Tuesday, one floor above his room at University of Colorado Hospital.

Standup comedian Gabriel Iglesias, who has appeared on Comedy Central, planned to headline a Denver fundraiser for Medley next week.

The fundraising might actually make Medley ineligible for some income-related assistance. His family and all other victims are already meeting with victim advocates, the case workers who deal with people hurt during crimes. The advocates determine what services they need and what assistance they qualify for.

"We have individuals who will need a lifetime of care, or a lifetime of accommodation, and our job is to make sure those needs are met," said Karla Maraccini, deputy director for community partnerships in the office of Gov. John Hickenlooper.

Mortgage Foreclosures Down in 2011 ? Real Estate News ...

According to the Spanish Mortgage Association (AHE), 6.63% of unemployed workers have been affected by mortgage foreclosure proceedings since the beginning of the crisis up to the end of 2011.

The number of affected unemployed more than doubles the total percentage of households involved in foreclosures in this period, which stood at 2.46%. Taking the whole of the population into consideration, the total percentage of mortgage foreclosures since 2007 stood at 0.74%.

By region, the percentage of the unemployed population affected by mortgage foreclosure proceedings since the crisis began ranges between the 10.17% recorded in Valencia and the 3.21% of Extremadura.

According to the AHE, 77,854 foreclosure proceedings were initiated in 2011, representing a decrease of 16.9% compared to 2010 ? the first drop after three consecutive years of increases. An annual decrease was recorded even though the quarterly figures showed a rise in the number of foreclosures initiated in the fourth quarter, compared with a fall in the third.

In contrast, El Mundo reported that the number of evictions continued to grow, reaching 58,241 in 2011, which represented an increase of 21% compared to 2010. As for the mortgage foreclosures, in 2011 the number of foreclosure proceedings initiated fell in all regions except in Galicia, where the number grew by 3.14%.

The largest decreases were recorded in Madrid, with a drop of 26.7%, Catalonia (-24.2%) and Castilla y Le?n (-23.5%). At the other end, the most moderate falls were registered in the Basque Country (-0.09%), Cantabria (-2.54%) and Arag?n (-6.02%). The region of Andalusia recorded the largest number of proceedings, with 21% of the total, above Valencia (19.1%), Catalonia (17.6%) and Madrid (9.7%).

Sally Ride Remembered: Tributes to 1st American Woman in Space

Sally Ride, the first American woman to fly in space, died Monday (July 23) at the age of 61.

Ride made history when she launched aboard the space shuttle Challenger on the STS-7 mission in 1983. She became only the third woman to ever travel in space, after Soviet cosmonauts Valentina Tereshkova in 1963 and Svetlana Savitskaya in 1982.

Ride traveled into space once more in 1984, as a member of the STS-41G crew on the space shuttle Challenger. Over the course of her career, Ride logged a total of 343 hours in space.

Sally Ride's death came after 17 months of battling pancreatic cancer. Here are some tributes to Sally Ride from astronauts, scientists, historians, industry officials and other luminaries:

Every four years, my body gets taken over by a strange fever, one that causes me to walk around town with arms swaying like a conductor with an invisible orchestra as the Olympic Anthem blares in my ears.

Go ahead, give it a listen. I'll wait. Don't you feel more patriotic, more connected with the world already??

This Friday, July 27, the Opening Ceremonies kick off the Summer Olympic Games in London. While most of London is scurrying to find its seats, I'm wondering what I'm going to serve at my party.

The way I see it, if you're planning to host an Olympic-inspired Opening Ceremonies party, you can either go London, go local, or go home.?

It's a common myth that English food is on the bland side, but before you start skipping London's signature fare, be advised: There are plenty tasty cross-pond dishes to be made and shared.
