Asiana crew twice tried to abort landing before SF crash

Crew members twice called to abort the landing of Asiana Flight 214 in the last 5 seconds before it crash-landed at the San Francisco airport last weekend, federal investigators said Thursday.

It was previously reported that the crew tried to abort the landing in the last few seconds before the crash Saturday at San Francisco International Airport. But Deborah Hersman, chairman of the National Transportation Safety Board, revealed in a briefing for reporters Thursday that there was also a second call for a "go-around" ? abandoning the landing attempt.

Why the plane clipped a seawall at the airport remains a mystery. Hersman said reviews of the automated pilot system, the automated throttles and the flight director systems all showed "no anomalous behavior."


Officials said debris from the airliner has been cleared from the runway, which could reopen as soon as Sunday.

Hersman said the NTSB has returned the runway to the jurisdiction of officials at San Francisco International Airport, but she said a grassy area where the fuselage of Asiana Airlines Flight 214 remained under NTSB control.

Doug Yakel, a spokesman for the airport, told NBC News it would probably take a few days before Runway 28 Left was operational again, which could be late Sunday or early Monday.

Two Chinese teenagers were killed and about 180 other passengers were injured when the Boeing 777 crashed. Seventeen people remained in area hospitals Thursday, three of them ? two adults and a child ? in critical condition.

Hersman was briefing reporters Thursday afternoon on the NTSB investigation, which is trying to answer several questions. She previously answered one of those Thursday ? telling NBC Bay Area that a flash of light the pilot reported having seen about 34 seconds before the crash wasn't a laser.

Hersman said at the briefing that the light, which could have been a reflection of the sun, didn't affect the pilot's vision.

Lasers pointers have become a significant problem for pilots, said the Federal Aviation Administration, whose records reflect an 800 percent rise in the number of such incidents from 2006 to 2012, the last year for which full figures are available. Pointing them at airplanes "can completely incapacitate pilots," it said, and it's a federal crime.?

Another mystery is why the plane wasn't immediately evacuated. Hersman said Wednesday that the doors weren't opened until about 90 seconds after the plane had come to a full stop. The standard is to have the plane fully evacuated within 90 seconds.

It also remains unclear why the plane's evacuation chutes prematurely opened inside the cabin on the plane's second impact ? they're supposed to open outward.?

And investigators also want to know why flight data indicated that the plane's automated systems recorded multiple "autopilot and autothrottle modes" as it approached San Francisco.

"There is automation there to support the pilots, but pilots also have to fly the airplane," Hersman told NBC News on Wednesday. "They have to monitor, and they have to fly."

Separately, emergency agencies were defending their response to the crash after recordings of passengers' and witnesses' calls to 911 reflected frantic concern that there weren't enough emergency crews on the scene.

Fire officials told NBC's TODAY that ambulances responded within 13 minutes and that private ambulances were already on the scene. The incident commander initially told them to keep away from the plane because of fears it could explode, they said.

A spokesman for American Medical Response, which provides ambulance services in 42 states, said ambulances had gone to a staging area before continuing to the wreckage in groups of five in accordance with a crash response plan.

It?s one thing for police to have statements from Carlos Ortiz that can be used to support the issuance of a search warrant. ?It?s quite another to be able to use those statements at trial.

Many of you instantly recognized that Ortiz?s explanation to police that Ernest Wallace told Ortiz that Hernandez told Wallace that Hernandez shot Odin Lloyd entails multiple levels of hearsay.

Let?s start this foray into trial procedure by assuming Ortiz will testify in the prosecution of Hernandez. ?Would testimony from Ortiz that Wallace said Hernandez said he shot Odin be admissible?

As the case often is with matters that eventually will be decided by a judge, the answer is ?maybe.?

Hernandez?s statement falls within the exclusion to the definition of hearsay, since the statement (?I shot Lloyd?) is being used against Hernandez. ?But Hernandez said it to Wallace, not to Ortiz. ?So when Wallace tells Ortiz that Hernandez told Wallace that Hernandez shot Lloyd, it potentially becomes hearsay.

Actually, there?s a chance that Wallace?s connection to Hernandez brings the entire statement within the exclusion to the hearsay rule. ?Section 801(d)(2)(E) of the Massachusetts Rules of Evidence says that ?[a] statement of a coconspirator or joint venturer made during the pendency of the cooperative effort and in furtherance of its goal when the existence of the conspiracy or joint venture is shown by evidence independent of the statement.?

In English, this means that if the effort to kill Lloyd and clumsily cover it up became a joint venture between Wallace and Hernandez, anything Wallace says about the joint venture isn?t hearsay. ?The pressure point would be whether telling Ortiz that Hernandez said he shot Lloyd constitutes a statement made ?in furtherance of [the] goal? of the joint venture.

Coincidentally, Bristol County, Massachusetts District Attorney Sam Sutter recently used the term ?joint venturer? when discussing the situation.

Another level of hearsay arises if, for whatever reason, Ortiz doesn?t repeat what he said to police in court. ?His own statements to investigators, made out of court and without an opportunity by Hernandez?s lawyer to cross-examine him, also become hearsay ? unless it?s determined that he?s another ?joint venturer,? even though his agenda on the night in question appeared primarily to be sleep.

Complicating matters in this context is the Confrontation Clause of the Constitution, which gives a criminal defendant the right to interrogate anyone giving testimony against the defendant. ?The statements Ortiz made to police about the events of the evening and Wallace?s comments about Hernandez?s confession are more likely to be admissible if Ortiz is not available to testify at trial; one issue that would need to be researched under Massachusetts law is whether invoking the Fifth Amendment right against self-incrimination makes the witness unavailable.

In the end, the judge presiding over the case will have to decide whether to allow the statement in to evidence. ?Factors that shouldn?t matter but that definitely will include whether the judge believes based on all of the other evidence that a conviction is likely without the statement being admitted. ?Since allowing the statement to go to the jury could be what lawyers and judges call ?reversible error? (in English, grounds for overturning the conviction on appeal), there?s no reason to do it if the evidence otherwise appears to be overwhelming.

It?s a very common dynamic at trial. ?If, all of a sudden, one side starts winning all of the evidentiary rulings, it?s a strong clue that the judge thinks the other side is poised to win the case. ?For Hernandez, despite the information made available to the media, it?s still way too early to tell how this one would play out in a court of law.

The good news is she is home, doing well and in good spirits.

The bad news, however, is that the Friday Harbor girl who was struck by a slow-moving car and then temporarily trapped beneath the 1950?s era convertible won?t be doing any cartwheels anytime soon.

Kevin Holmes said his daughter Jessica suffered a broken ankle and a bit of road rash as well. Holmes noted that the front tire of the car did not, as some suspected, run over Jessica?s leg.

?A lot of people have been asking so we wanted to let them know she?s okay,? he said.

Both Jessica and the driver of the Thunderbird convertible were participating in the parade on behalf of San Juan Island Library. Jessica was carrying a banner when she stumbled, fell, and then ended up underneath the car, which had been crawling along directly behind her.

Massive Wildfires Near Las Vegas And Reno Are ... - Business Insider

More than 800 firefighters are battling two massive wildfires moving through mountain areas near Las Vegas and Reno, Nevada, NBC News reports.

The fires 35 miles northwest of Las Vegas are only 15% contained as of Tuesday evening, and span almost 31 square miles. So far, there have been no injuries or reported property damage.

More than 500 residents and another 98 teens at a youth correctional camp have been evacuated. Several local casinos have said they would make their rooms available to the displaced, Casper Star-Tribune reports.

It?s burning in pinion, juniper and bristlecone pine forest in rugged territory covering more than 30 square miles and continues to threaten about 400 homes. More than 500 residents and another 98 teenagers at a youth correctional camp have been evacuated since the weekend.

?It?s dry,? Nichols said. ?We?ve got torching trees and spotting fire. We?re being extremely careful and monitoring the safety of firefighters and the public.?

The caution is justified ? after the death of 19 firefighters?who were battling a blaze in Arizona less than 10 days ago.

In addition to hundreds of personnel, there are?44 engines, 10 water tenders,?nine helicopters, and a DC-10 tanker plane that can drop 11,700 gallons of fire retardant on the scene, according to NBC News.

The Vegas-area fires are just?two of 21 uncontained large fires currently burning across the country.

Facebook opens Montreal office to work with marketers in Quebec

MONTREAL ? Facebook has opened an office in Montreal to better tap into business opportunities in Quebec.

The company announced Wednesday that its latest Canadian branch is now open, with two employees based in Montreal to serve businesses looking to expand their presence on the social network.

Facebook also launched a temporary office in Vancouver last month, which was expected to stay open for a year-long stint.

Facebook, which says it has 18 million users in Canada, opened its first Canadian office in Toronto in November 2009.
